Policy for the processing of personal data at „FORMA SYSTEM” Ltd.
Introduction
RODO is the commonly used abbreviation for Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), which applies from 25 May 2018. The RODO establishes uniform rules for the processing of personal data in all Member States of the European Union.
Information
Pursuant to Article 13(1) and Article 14(1) and (2) of the RODO, we would like to inform you about the manner and purpose for which we process your personal data, as well as about your data protection rights. „FORMA SYSTEM”, not being obliged to do so, has not appointed a Data Protection Officer.
We process your data in accordance with the provisions of the RODO and Polish data protection legislation, fulfilling contractual obligations and taking data subjects' actions prior to entering into a contract (Art. 6(1)(b) RODO), as well as fulfilling legal obligations (Art. 6(1)(c) RODO).
The data is processed for the purpose of providing services in the performance of contracts concluded with customers or for the performance of activities prior to or in connection with the conclusion of a contract.
„FORMA SYSTEM” is subject to legal obligations arising, for example, from labour and social security legislation, accounting and tax legislation. If necessary, we will process your data in order to fulfil the requirements imposed by, among others, the aforementioned regulations.
We process data for purposes arising from legitimate interests pursued by „FORMA SYSTEM” or a third party (Article 6(1)(f) of the DPA). The legitimate interests of „FORMA SYSTEM” arise from acting to ensure the protection of persons and property, the assertion and defence of claims, the direct marketing of „FORMA SYSTEM” products and services, for internal administrative purposes of „FORMA SYSTEM”.
We process your data on the basis of your consent (Article 6(1)(a) RODO), given for specific purposes. Consent may be withdrawn at any time. The withdrawal of consent does not affect the lawfulness of the processing of data by „FORMA SYSTEM” up to the time of withdrawal of consent or in situations where „FORMA SYSTEM” processes data on the basis of a legal ground other than your consent.
The data may be shared with other parties for the performance of the concluded contract, for the performance of a legal obligation incumbent on „FORMA SYSTEM”, based on your consent or for purposes arising from the legitimate interests of „FORMA SYSTEM” or a third party.
Recipients of data may be entities processing data on behalf of „FORMA SYSTEM”, however such entities process data on the basis of a contract with „FORMA SYSTEM” and exclusively in accordance with „FORMA SYSTEM” instructions and on condition of maintaining business secrecy. The group of entities performing tasks on behalf and for the benefit of „FORMA SYSTEM” includes entities providing services in the area of ICT, debt collection, legal, insurance activities.
Your data will not be transferred to a third country (outside the European Union).
Your data will be processed for the period necessary to fulfil the purposes of the processing:
- in the scope of performance of the contract concluded with „FORMA SYSTEM” - until its completion, and after that time for the period required by law or for the exercise of any possible claims,
- in terms of fulfilling the legal obligations incumbent on „FORMA SYSTEM” in connection with the conduct of its business and the performance of concluded contracts - until such time as „FORMA SYSTEM” fulfils these obligations,
- as regards processing carried out solely on the basis of consent, until such time as it is immediately deleted
data carried out on the basis of a request made by you, - until the fulfilment of the legitimate interests of „FORMA SYSTEM” which form the basis of the
such processing or until you object to the processing, unless you
there are legitimate grounds for further processing.
You have the following rights:
- request access to your data, rectification, restriction of processing or erasure,
- to withdraw at any time the consent previously given for the processing of data to the extent of the consent,
- to request the transfer of data provided to „FORMA SYSTEM”,
- lodge a complaint with the supervisory authority, which is the President of the Office for the Protection of Personal Data, if the processing of your data violates regulations, including the RODO,
- to object to the processing of data by „FORMA SYSTEM” on grounds relating to your particular situation when „FORMA SYSTEM” processes the data for the purposes of legitimate interests (Art. 21 (1) RODO).
Insofar as the processing of your data takes place for the purpose of concluding and performing a contract with „FORMA SYSTEM”, the provision of your data is a condition for the conclusion of this contract. The provision of data is voluntary but necessary for the conclusion and performance of the contract with „FORMA SYSTEM”.
The majority of data processed by „FORMA SYSTEM” comes directly from the subject concerned, in particular the customer. Some of the data may originate from entities to which you have given your consent to their transfer, from persons representing you, from public registers and registers (e.g. the National Court Register, the Central Register of Business Activity Information), they concern data identifying the customer, contact data.
The processing of your data is not automated and does not involve automated decision-making and is not subject to profiling.
